What the law says
Under Maryland Business Regulation § 8-617, a home-improvement contractor may not accept a deposit of more than one-third of the contract price before work begins. The rule applies to roofing, siding, windows, kitchens, bathrooms, flooring and every other home-improvement job done by an MHIC licensee.
Maryland also requires the contract itself to be in writing and to carry the contractor’s MHIC licence number (Business Regulation § 8-501). A quote on the back of a business card is not a contract.
What a fair payment schedule looks like
A deposit of up to one-third at signing, then payments tied to visible progress: materials delivered, rough-in inspected, tile set, and a final payment after the walkthrough and punch list. Every payment should match something you can see finished.
Be careful with schedules front-loaded by date rather than by work. A payment due on the 15th whether or not anything has happened is a schedule built for the contractor’s cash flow, not your protection.
If a contractor asks for more
Say no, and ask why. Special-order items such as custom cabinets or windows sometimes need to be paid for early, but the legal cap still applies to the deposit, and a reputable contractor will put any material payment in writing against a delivery.
Check the licence before you pay anything. The Maryland Department of Labor publishes a free MHIC licence lookup, and a homeowner who hires a licensed contractor can bring a claim to the Home Improvement Guaranty Fund if the job goes wrong. Hire an unlicensed one and that protection is gone.
